1. Accepting RewardFish™ Program Rules
The RewardFish™ Rewards Program (the “Program”) is offered exclusively by Edvisors Network, Inc. (“Edvisors”). The Program is a customer rewards program offered by Edvisors whereby Edvisors customers can earn and use RewardFish points ("RewardFish Points" or "Points") in accordance with the terms and conditions below. The following terms and conditions (hereinafter "Program Rules" or "Rules") apply to the Program.
Edvisors may, in its sole discretion and without notice, alter, limit, or modify the Program Rules, benefits, eligibility for Membership, or any other feature of the Program (including assigning any of its obligations to customers under the Program at any time to another person or entity, without recourse) this includes modifying, altering, adding or deleting program benefits, point values, redemption levels, conversion ratios, reward delivery methods and conditions for active status. These changes may affect the value of the Points or benefits already accumulated.
Program Rules published at RewardFish.com supersede all information previously published and will serve as current posted Program Rules. Each member shall be responsible for periodically visiting this site to view any changes as such changes will apply to all members regardless of enrollment date. Edvisors may, but is under no obligation to, provide advance notice of changes to the Program Rules by posting a notice on the RewardFish™ website or sending an email notice to Members. YOUR CONTINUED USE OF THE REWARDFISH™ WEBSITE OR PROGRAM FOLLOWING CHANGES TO THE PROGRAM RULES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES.
To ensure proper reward delivery, members are responsible for keeping their email and mailing addresses current at Rewardfish.com.
Edvisors may terminate the Program any time at its sole discretion, by posting any such changes on the RewardFish website.
No purchase is necessary to become a member of the Program.
The Program is open to individual United States legal residents residing in the fifty States, District of Columbia and Puerto Rico. Only individuals that are 18 years of age or older may enroll in the Program. Individuals who enroll in the Program are referred to as "Members" of the Program. Members must be living individuals; corporations, groups or any other types of entity are not eligible. By joining or otherwise participating in the Program, you represent and warrant that you are at least 18 years of age or older and a resident of an eligible jurisdiction. Members must reside in the United States while using their RewardFish™ Account. Methods used to obscure or hide the country or location of a computer or device or the use of a VPN, Private or Proxy IP to connect to RewardFish.com is prohibited. Members must provide a valid email address during registration in order to activate their RewardFish™ Account and maintain an up-to-date email address associated with their account at all times because email will be the primary method by which Edvisors communicates with you regarding your account and to provide promotional offers. You consent to receive communications, including account notices, from Edvisors to the email address associated with your account.
Members may not create more than one Account with RewardFish™.
This Program is not targeted towards, nor intended for use by, anyone under the age of 18.
3. Earning Points
As a RewardFish™ Member, you can earn and accumulate Rewards Points by successful participation in certain activities. The award of Points is contingent on Edvisors and/or its third-party Rewards Program partners being able to accurately track and validate the Member’s completed point-earning activity. Edvisors shall not be responsible for, nor shall Edvisors be obligated to award Points or Rewards to Members for any activity that is not properly recorded, tracked and/or deemed approved under Edvisors’ or its third-party Program partners’ policies, procedures and systems.
If Points are contingent upon satisfying a third party’s rules, policies, and procedures and such third party informs us that your participation did not satisfy their rules, policies, and procedures, we may, in our sole discretion, reverse the applicable award of Points and cancel any Reward for which such Points were redeemed. Further, if you return or seek a refund for a purchased good or service for which you earned Points, we may reverse the award of Points and cancel any Reward for which such Points were redeemed.
If at any time your Points balance becomes negative due to Points adjustments by us, we may, with or without notice, cancel any outstanding Rewards or other offers associated with your account and/or terminate your account. Negative Points balances do not expire but, so long as the account remains active, may be eliminated through the earning of additional Points.
4. Redemption and Points Expiration
Members may redeem Points earned for Rewards (“Rewards”). Rewards include gift cards, services, experiences, charitable donations, PayPal deposits, or promotional activities such as sweepstakes featured on the RewardFish™ site. RewardFish Members must sign into their RewardFish Program account so that the number of Points can be validated. RewardFish Members are able to redeem no more than 10,000 Points per day. Members will only able to redeem up to 2000 points the first time they try redeeming Points. Rewards may be subject to review and approval by Edvisors adn Edvisors does not guarantee Rewards delivery within any period of time or that Rewards will be approved. Edvisors reserves the right to change the maximum number of Points a Member can redeem per day without notice. In some instances, Edvisors may update the Rewards offered or discontinue offering specific Rewards. The selection of gift cards offered is and will be at the sole discretion of Edvisors and may change without notice.
Some Rewards may have additional eligibility requirements or other terms imposed by the Rewards' provider, sponsor, or administrator. You must comply with such eligibility requirements or other terms in order to receive and/or use the Rewards. Gift cards and gift certificates are valid at participating merchants only, and are subject to the issuer’s terms and conditions, which, if permitted by law, address expiration policies and nonusage fees and can be changed at the sole discretion of the issuer.
Members will receive an email that provides them with a link to the RewardFish™ site in order to redeem their Reward. Members must log into their Account to redeem their Reward. Processing times may vary. Rewards that are undeliverable or unclaimed, for any reason (including, without limitation, because a Member’s email address is incorrect or outdated) may not be reissued and therefore forfeited, and the Points will not be refunded.
Points expire and are redeemed in the order in which they are awarded. Points automatically expire twenty-four (24) months after they are earned unless redeemed for Rewards.
5.Fraud and Prohibited Activity
Members are strictly prohibited from engaging in or assisting or facilitating others to engage in fraud or other activities that may cause harm to Edvisors, other Members, or any third party, including, without limitation, using bots, macros, or other automated mechanisms to engage with the Program, hiding the true location from which the Member is engaging with the Program, providing erroneous or fake data, creating multiple accounts, making purchases without intent to receive the goods/services purchased, using third parties to engage with the Program on the Member’s behalf, or interfering with Edvisors’ systems or network. Members are also prohibited from engaging in any behavior that may constitute harassment, intimidation, bullying, abuse, defamation, slander, or libel. Edvisors will determine, in its sole discretion, whether a Member has engaged or assisted or facilitated others to engage in fraud or other prohibited activities, and all decisions of Edvisors are final. In addition to any other remedies Edvisors has under these Rules, Edvisors may suspend your account while it investigates any behaviors that may violate this provision. If your account is suspended or cancelled for violating this provision, you may send a written request to customer service at [email protected]for more information and to seek a review of the determination; however, Edvisors is under no obligation to grant the review or to make any change to your account status based upon it.
6. Inactive Accounts
Any RewardFish Member Account in which there is no account activity (defined as, Member has not logged into their Account and has not earned Points or converted Points into Rewards for twenty-four (24) consecutive months or more) will be deemed inactive and the Account closed. Inactive Accounts subject to closure will result in forfeiture of all accrued and unused Points and/or Rewards. We reserve the right to modify our inactive Account rules and policies in our Rewards Programs from time to time, and if your Account becomes inactive pursuant to such then-current rules or policies, we may close your Account, without any compensation or further obligation to you.
7. Transfers of Membership and Rewards
RewardFish™ memberships, Rewards, and Points (i) cannot be transferred, assigned to anyone including Member’s estate, their successor or assignees; (ii) have no cash value; (iii) may not be purchased or sold; and (iv) are not redeemable for cash under any circumstances. Accrued Rewards and Points do not constitute property of the Member, nor are accrued Rewards and Points transferable by the Member upon death, divorce, or for any other reason or purpose. Rewards and other benefits of the Program may be taxable to the Member where required by law.
8. Membership Cancellation
Cancellation by You
We hope you will not, but you may cancel your Program membership at any time and for any reason by cancelling your RewardFish™ Account by sending us notice at [email protected], communicating with us through the online chat function at www.rewardfish.com, or indicating your desire to cancel by using the appropriate function in your RewardFish™ online profile. Any cancellation request will be processed within 5 business days of receipt of such request. Upon termination, your RewardFish™ Account (and your RewardFish™ Account info and Rewards info) will no longer be accessible. Any accrued Points or Rewards will automatically expire upon membership cancellation.
Cancellation by Us
Edvisors reserves the right to exclude individuals from the Program, with or without notice, in its sole discretion. Without limiting Edvisors’ rights in the prior sentence, any abuse of the Program, failure to follow any terms of the Program, membership inactivity for more than 24 months, and any misrepresentation or any conduct detrimental to the interests of Edvisors may subject Members to membership revocation or cancellation and will affect eligibility for further participation in the Program. If your Membership is revoked or otherwise cancelled by Edvisors, any accrued Points and Rewards will automatically expire.
If your account is cancelled for any reason, you may request to reactivate it by emailing us at [email protected] or communicating with us through the online chat function. We may, in our sole discretion, decide whether to reactivate your and whether to restore some or all of the Points or Rewards associated with your account when it was cancelled. If your cancelled account was not flagged for potential fraud or violations of the Program Rules, and you have never cancelled your account with us previously, it will typically be eligible for reactivation and restoration of some or all Points and Rewards during the first six (6) months after cancellation; however, we do not guarantee reactivation or restoration of Points or Rewards.
Please note that if you create an account with an email address that differs from the cancelled account, that account will be treated as an entirely new account and you will not be eligible to have your cancelled account reactivated.
We may also give you the option or require that you utilize multi-factor authentication in connection with your account. Multi-factor authentication is designed to reduce the risk of a third-party gaining unauthorized access to your account. We do not guarantee the security of your account even if you use multi-factor authentication. By using multi-factor authentication, you authorize us to contact you for authentication purposes at the phone number or email address you provide.
11. Social Activity Disclosure
To the extent you are incentivized to earn Points through social activities, where such activity(ies) could be construed to be an endorsement of Edvisors brands, products or business, you are required to disclose the incentive so the audience understands your relationship with Edvisors (e.g., #EarnedRewardFishPoints, #Sponsored). You are solely responsible for complying with the FTC’s Guidelines Concerning the Use of Testimonials and Endorsements in Advertising and should review them carefully before engaging in any social activity related to the Program or the Edvisors brands, products, or business.
12. Tax Matters
We cannot determine, in every instance, whether the Points, Rewards, or credits a Member has earned or redeemed in the RewardFish Program are considered reportable taxable earnings. Thus, each Member is responsible for any and all tax liability arising from or associated with the use of the Edvisors Websites and Services, including, but not limited to the accrual of RewardFish Program points or redemption of such points. We will require you to provide the necessary tax reporting information if we believe that you are or may be required to report the value of your Points, Rewards, prizes, or credits to an appropriate tax authority.
Edvisors will file a 1099 tax form for any Member who redeems Points for Rewards valued in aggregate at $600 or greater in one calendar year. Once our records indicate you have reached the $600 or greater threshold in any calendar year, we will require you to provide necessary tax information about yourself prior to redeeming additional Points.
We are not tax professionals and are not able to advise you regarding tax implications of your activities. We recommend that you seek advice of a tax expert in order to help determine the tax consequences of your activities on any Edvisors Sites, and any associated Points, Rewards, prizes or credits earned or redeemed.
